1. HOW TO ENTER
a. The Holiday Lights Contest (“Contest”) will begin on 12/04/2008 and end on 12/21/2008 at 5:00pm Mountain Time (“MT”) (the “Entry Period”).
b. To participate in the Contest, listeners will be invited to visit KWLI (92.5 THE WOLF), KXKL (KOOL105), and KIMN (MIX100) online at www.925thewolf.com, www.kool105.com, and www.mix100.com and enter the Contest using the online entry webpage. Entrants must submit their first name and last name, complete address, city, state, zip code, telephone number, date of birth, and a valid email address in the online entry form. Also, entrants must submit a photo of their residence decorated in holiday lights (“Photo”) on the online entry form and confirm consent to permit KWLI, KXKL, KIMN to post the photos online during the Entry Period.
c. The Photo must be in the following format: .jpeg, .gif or .tiff. File size must not exceed 1MB. Each submitted Photo must be the original creative work of each Entrant and must not be edited or manipulated in any manner (electronic or otherwise) or contain copyrighted materials or any other materials that may be restricted, prohibited or outlawed by federal, state or local laws. All Photo submissions will become the property of the Station and will not be acknowledged or returned. The Station may use the Photos in any manner or medium. Station has the absolute discretion to disqualify an entry based on its sole judgment. Station, in its sole discretion, reserves the right to disqualify any entry if such entry contains illegal, indecent or otherwise offensive material, or if such entry contains material whose content is deemed at the sole discretion of Station to be unsuitable for public performance, broadcast on Station, or posting on Station’s website (i.e. entries must be radio clean). Entries that do not comply with these rules will not be eligible.
d. Beginning on Friday, 12/12/2008 at 5:00pm MT, listeners will be invited to begin voting for their favorite Photo submissions. The “Online Voting Period” will continue through 12/21/2008 at 5:00pm MT. Grand Prize winner will be determined based upon the total number of online votes received on Monday, 12/22/2008 at 9:00am MT.
e. Only one internet entry per household, per person and per email address is permitted. Internet entries will be deemed made by the authorized account holder of the email address submitted at the time of entry. The authorized account holder is the natural person who is assigned to the email address by an internet access provider, online service provider or other organization that is responsible for assigning an email address or the domain associated with the submitted email address. Multiple participants are not permitted to share the same email address. All entries submitted become the sole property of the Station and will not be acknowledged or returned. Use of any device to automate entry is prohibited. Proof of submission of an entry shall not be deemed proof of receipt by Station. Station’s computer is the official time keeping device for the Contest. The Station is not responsible for entries not received due to difficulty accessing the internet, service outage or delays, computer difficulties or other technological glitches.
2. ELIGIBILITY RESTRICTIONS
a. The Contest is open to all KWLI (92.5 THE WOLF), KXKL (KOOL105), and KIMN (MIX100) listeners who are legal Colorado residents, age 18 or older and who live in the Denver Metro area. Employees of KWLI (92.5 THE WOLF), KXKL (KOOL105), and KIMN (MIX100) (the “Station”), its licensee, its parent, subsidiary, and affiliated entities, its advertising agencies, participating sponsors/promotional partners, other radio stations in the Denver metropolitan area and the members of their immediate families and/or households are ineligible to participate or win. Subject to all applicable federal, state, and local laws and regulations. Void where prohibited.
b. Entrants are required to provide truthful information and the Station will reject and delete any entry that it discovers to be false or fraudulent. The Station will disqualify any entry from individuals who do not meet the eligibility requirements, and the Station will also delete any entry knowingly received from persons under the age of 13 in compliance with the Children’s Online Privacy Protection Act.
3. PRIZES
a. One (1) Grand Prize: Pending verification by the Station, the Grand Prize winner will receive a check from CBS Radio Denver in an amount equal to their household’s December 2008 electric utility bill. The utility bill must be in the name of the prizewinner, must specify the address identified by the prizewinner in their online entry form, and must be for energy consumption during the month of December 2008 only. Limit $1,500.00 total.
b. Grand Prize winner will need to mail or bring in person their original December 2008 utility bill. The winner will forfeit any prize or prize certificate not claimed within forty-five (45) days of winning. In the event that a prize or prize certificate is mailed to the winner, it will be with the prior written consent of the winner and therefore, winner assumes the risk of its loss. The Station is not responsible for the safe arrival of a prize or prize certificate.
c. There is no substitution, transfer, or cash equivalent for prizes, except that Sponsor may, at its sole discretion, substitute prizes of comparable value or cash. The prizes are expressly limited to the item(s) listed above and do not include taxes, gratuities or any other expenses. Other restrictions may apply.
4. WINNER SELECTION AND NOTIFICATION
a. Decisions of the Station management with respect to the Contest are final.
b. One (1) Grand Prize winner will be selected based upon the total number of votes received during the online voting period described above.
c. Grand Prize winner will be determined by the Station on Monday, 12/22/2008 at approximately 9:00am MT based upon the total number of votes received during the Online Voting Period. Grand Prize winner will be notified by phone. Winner does not need to be listening or be present to win.
d. Grand Prize winner will be required to mail or bring in person their original December 2008 utility bill as described above. In addition, the Grand Prize winner must execute and return any required affidavit of eligibility and/or liability/publicity release within ten (10) days of winning or prize will be forfeited and an alternate winner may be selected by the Station from the runner up submissions. If a potential winner cannot be contacted, fails to sign and return the required affidavit of eligibility and liability/publicity release within the required time period, or if a prize or prize notification is returned as undeliverable, potential winner forfeits prize.
5. CONDITIONS
a. Payments of all federal, state and local taxes are solely the responsibility of the winners. Winners will be required to complete and submit an IRS Form W-9 with the winner’s full Social Security Number or the equivalent for receipt of any prize valued at $600 or more or for any prizes awarded by the Station in a calendar year with an aggregate value of $600 or more. Failure to submit a complete W-9 or equivalent will result in forfeiture of the prize.
b. By participating in the Contest, the winner or winners agree to have their name, voice, or likeness used in any advertising or broadcasting material relating to this Contest without additional financial or other compensation, and, where legal, to sign a publicity release confirming such consent prior to acceptance of the prize.
c. Prior to awarding any prize or prize certificate, the Station in its sole discretion may require Contest winners (and their travel companions, if any) to sign a liability release, agreeing to hold the Station, its licensee, its parent, subsidiary and affiliated entities, and the officers, shareholders, directors, employees, agents and representatives of each of them harmless against any and all claims or liability arising directly or indirectly from the prize or participation in the Contest.
d. The Station reserves the right to make changes in the rules of the Contest, including the substitution of a prize or equivalent value, which will become effective upon announcement. If due to circumstances beyond the control of the Station, any competition or prize-related event is delayed, rescheduled, postponed or cancelled, the Station reserves the right, but not the obligation, to cancel or modify the Contest and shall not be required to award a substitute prize.
e. Failure to comply with the Contest rules may result in an entrant’s disqualification solely at the discretion of the Station.
f. The Station is not responsible for typographical or other errors in the printing, the offering or the administration of the Contest, or in the announcement of a prize.
g. For the names of the prize winners, send a self-addressed stamped envelope for receipt by 02/19/2009 to “Holiday Lights Contest” – Winners, Attn: Promotions, KWLI (92.5 THE WOLF), KXKL (KOOL105), and KIMN (MIX100) 1560 Broadway, Suite 1100, Denver, CO 80202. For Official Rules, send a self-addressed stamped envelope to the above address marked “Holiday Lights Contest – Official Rules” for receipt by 12/21/2008. The names of Prize Winners and the Official Rules will also be posted at www.925thewolf.com, www.kool105.com, and www.mix100.com.
